Terms & Conditions

Definitions
The client refers to the company or individual requesting the services. Adoublem refers to the owner & responsible party for completing the work.

The monthly package plan or reserved appointment between Adoublem and the client will be based on these conditions, and any variations to these conditions shall have no effect unless agreed in writing.

It is important that any of the work requested is not in any way illegal. Regarding a website, Adoublem shall expect the client to carry out sufficient research before proceeding with a website. This will include checking that the website/ idea/business will operate legally within U.S. law.

Individual Projects & Package Plans
Work is either done as an individual project (most often) or as part of a monthly package plan. Work done through packages will take priority over individual projects. Price is determined in advance for package plans. Individual projects that are reserved through our Availability Calendar will take priority over projects that are submitted through email or by phone. An estimate for individual projects will be provided only when a client has requested it.

A project estimate is subject to change due to the scope of the project changing or because the time it takes to complete the project has increased or decreased from the estimate.

Ongoing Projects
Ongoing projects are no longer available (excluding web maintenance).
Work done through ongoing packages will take priority over other projects that are not part of a package. Packages are limited in number and require an annual, twelve month contract. This contract auto-renews each year, unless either party cancels it. This contract may be canceled by either party at any time, with 30 days advance notice in writing. Packages will be billed monthly, and invoices are due upon receipt. In most cases, the work to be completed will be decided & stated in the contract. Additional work completed outside the contract in most cases will be included in monthly invoices and due upon receipt. Packages are priced by project, not by hour. Hours do not carry over from one month to the next.

Start of Work
For individual projects reserved using Adoublem’s Availability Calendar, Adoublem will begin work on the scheduled day (as long as all required materials and deposits, if any, have been received from the client). Other individual projects submitted through email or by phone will be added to the job queue and completed on a first come, first serve basis, after any reserved projects or monthly plan projects. For packages, Adoublem will begin work once the client approves the annual contract.

Rush Jobs
We make every effort to accommodate rush orders. Due to nature of our business we may be completely booked at times, therefore reserving time on Adoublem’s Availability Calendar as early as you can will help ensure the timely completion of your project. For rush jobs, a surcharge will be charged for projects requiring less time than our published time frames (see below), or projects with less than 24 hours notice and evenings, weekends or holidays.

Adoublem Typical Project Time Frames:
Projects may be completed earlier than the time frames listed below, but it is not guaranteed. These time frames include time for completing the project, as well as collaborating/getting approvals from a client. They do not include additional time for printing or shipping, please plan accordingly.

Please note: These are the typical time frames once we receive the necessary information from the client (at the time the order is placed). Time frames are subject to change. Larger projects will have longer time frames.

  • Brochures, Booklets, Social Media designs: 5-10 business days
  • Flyer, Binder Covers, Rack Cards, Postcards: 5-7 business days
  • PowerPoint Sales Presentations: 5-10 business days
  • Website Maintenance: 1-5 business days, depending on the work needed
  • Websites (new): 30 business days
  • Other Projects: Depends on the scope of work – TBD

Deposits & Payment Terms
All invoices are due upon receipt, unless other arrangements have been made in writing. Invoices can be paid by check, cash or credit card in person or securely online (link to pay online is included in the invoice email). A 50% deposit is taken for any project over $500, except when other arrangements have been made in advance. If Adoublem is required to purchase anything for the client (for example client gifts, printing fees, etc.), these purchases must either be paid in advance by the client or paid with the client’s credit card.

For individual one-time projects that are not part of a package, billing will take place every Monday for work completed Sunday through Saturday the previous week, and invoices are due on receipt.

Packages will be billed monthly and invoices are due on receipt.

Unpaid Invoices and Late Fees
If the client has an outstanding invoice 15 days overdue, Adoublem will cease all services, and all work (current and upcoming) will be placed “on hold” until the client has paid the total amount owed.

A $50.00 late fee will be applied monthly to unpaid invoices (a $50 fee each month until the invoice is paid). Please note, for the first month only, the late fee will be broken into two $25.00 payments, one at 15 days and one at 30 days.

Project Completion Date
For all projects, we will do everything we can to meet any agreed deadline, or if no specific agreement has been made, our published project time frames. Due to unforeseen circumstances (such as unexpected emergencies, acts of God, missing documents from the client, etc.), we do not guarantee and are not bound in any way to complete the project by this date (the agreed upon date/time, or if no agreement has been made, our regular project time frames). Adoublem will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.

For design projects, the client agrees to make available as soon as is reasonably possible to Adoublem all materials required to complete the work to the agreed standard and within the set deadline.

Refunds
Adoublem reserves the right to decide whether a refund is applicable if the client requests it for any reason. Adoublem does not guarantee a refund. All our work is done with your 100% satisfaction in mind. If you feel something is not done right, let us know and we will fix it right away.

Cancellation of Services
A client may cancel their online reserved project within 48 hours before the start time of this project. If a project is canceled less than 48 hours before a scheduled reservation, a $50.00 fee will be applied. If money was paid in advance, refunds will be at the sole discretion of Adoublem depending on the circumstances.

Further, Adoublem will consider a project canceled if the predetermined deposit or payment in full is not received within 30 days. Further, Adoublem can terminate a project if the client fails to provide information needed to complete the project (artwork, logo, text copy, etc.) within 30 days, and all monies paid may not be refunded.

If the client abandons a project, the client will be required to pay for all the work already completed before the project was abandoned. A scheduled/requested project reserves the time of team members and research time, etc. Thus, the client may also be responsible for the cost of the full project if the project is abandoned with no notice or follow up.

Annual Packages may be canceled by either party at any time with 30 days advance notice in writing.

Non-Disclosure
Any information disclosed to Adoublem by the client, or from Adoublem to the client in connection with work, will be considered proprietary and confidential, including all such information relating to both company’s past, present, or future business activities, research, product design or development, personnel, and business opportunities.

Confidential information shall not include information previously known to either company, the public, or previously recognized as standard practice in the field.

All confidential and proprietary information will be held in confidence, and neither party will use such information except as authorized by the client or Adoublem, and both parties will prevent any unauthorized dissemination. Both parties acknowledge that unauthorized disclosure could cause irreparable harm and significant injury.

Client Artwork
Adoublem respects any professional artwork provided by the client and will only use it to achieve the project’s goals. The copyrights will remain the client’s. Adoublem will not take the client’s artwork for use on any other site, resell it, or give it to anyone under any circumstance. Adoublem guarantees that all information shared with it, including artwork, contact information, client notes etc. will remain confidential.

Adoublem Site Policy and Modification
Adoublem reserves the right to make changes to their website (www.adoublem.com), policies, and these Terms and Conditions at any time. If a client has an active project, the policies in effect when that project was approved and/or started will remain in effect.

Web Specific
Adoublem cannot be held responsible for problems or additional costs due to errors made by third parties, or the client’s failure to maintain a current copy of their website.

Browser Compatibility
Adoublem makes every effort to design pages which display acceptably in the most popular current browsers, but cannot accept responsibility for pages which do not display acceptably in new versions of browsers released after pages have been designed, or in the case of outdated browsers.

Images
Images purchased by Adoublem on behalf of the client are strictly for use on their website only. Adoublem is not liable for misuse of these images by the client or any other person for copying, altering or distributing the images to individuals or other organizations.

Domain Names
The client will purchase domain names in advance, or Adoublem can purchase the domain name for the client. Regardless of how the domain name is purchased, the client will be the legal owner of the domain name. It is the responsibility of the client to renew their domain names when due. If a domain name expires, Adoublem cannot be held liable for this. However, Adoublem will make a reasonable effort to contact the client regarding domain renewal (if Adoublem was involved in the purchase of the domain name). If a domain name is not renewed, it will become available to the public & it is possible for another company to use it.
